Ohio Online Gambling Laws
Online gambling is a hot topic in the United States. There are many different types of gambling, including casinos, virtual poker, sports betting, and lotteries. If the laws are not strictly enforced, the Internet may bring illegal gambling to the U.S. Thankfully, many of the federal laws that prohibit illegal gambling on contests and sporting events are directly applicable to the Internet.
The CRS Report RS21984 cites a number of statutes in the context of the Internet’s gambling capabilities. For example, the United States v. Grey, the sixth Circuit’s case involving the first online lottery, includes several references to gambling. It also mentions the UIGEA, a law designed to protect consumers against unscrupulous businesses.
The most important thing to know is that a number of states have adopted laws that allow for the legalization of online gambling. Illinois, Indiana, Massachusetts, and New Jersey are among the states that have legalized the Internet’s most popular pastime. Some of the states that have not yet embraced online gambling include Connecticut, Rhode Island, and New York.
As the state of Ohio moves toward offering more sophisticated online gaming options, it is crucial to understand which laws will apply to which activities. Generally, online gaming and gambling is considered to be a state-regulated business, and all businesses seeking to do business in the state need to obtain a license from the Ohio Casino Control Commission. This allows the commission to oversee and regulate the licensing and regulation of businesses in the gaming industry.
Those seeking to engage in illegal internet gambling should be aware of the Illegal Gambling Business Act (IGBA), as well as the Wire Act, which prohibits gambling on contests and sporting events. Also, the Federal Communications Commission has authority over common carriers, and it is possible that the agency may stop providing, renting, or maintaining facilities in the future. These restrictions have been put in place because of the alleged risks associated with Internet gambling.
Another statute, the Travel Act, specifically protects travelers from taking part in unlawful Internet gambling. Even though the United States has yet to officially legalize online gambling, it is clear that the online gambling industry will continue to grow, and more and more Americans will be able to place wagers on sports and other entertainment.
